Browser “Do Not Track” Signals. Most browsers contain a “do-not-track” setting. In general, when a “do-not-track” setting is active, the user’s browser notifies other websites that the user does not want her/his personal information and online behavior to be tracked and used, for example, for interest-based advertising. Personal Information Collected
For the purposes of this Privacy Policy, “personal information” shall mean individually identifiable information from or about an individual. We collect personal information when you register for certain of the Site Offerings. Use and Sharing of Personal Information
Alex and Ani® will never sell, rent, exchange or barter your personal information to or with any third party for financial gain or marketing purposes. Where you register to access any of the Site Offerings, we use the personal information that you make available to personalize your experience with the Site, facilitate your purchase of Products/Gift Cards, facilitate the provision of the applicable Site Offerings to you and for verification purposes. You also agree that we may contact you at any time with updates and/or any other information that we may deem appropriate for you to receive in connection with your continued use of the Site Offerings, and to keep you informed of our other products and/or services, as well as third-party products and/or services, that we think may be of interest to you.

The personal information that you submit to Alex and Ani® remains your property, but by making that personal information available to Alex and Ani®, you grant Alex and Ani® the right, subject to applicable state and federal law, to use that personal information to send you our Newsletter, Mobile Message Service messages (where we have obtained your requisite prior consent) and other communications that contain offers from Alex and Ani® and certain third party partners that Alex and Ani® believes may be of interest to you. We may permit our third-party agents, service providers, vendors and subcontractors to access your personal information, but they are only permitted to do so in connection with performing services for us and/or to operate the Site Offerings. We reserve the right to release current or past personal information (including Sensitive Information): (i) in the event that we believe that the Site Offerings are being, or have been, used in violation of the Terms and Conditions, the rules applicable to any Promotion or to commit unlawful acts; (ii) if the information is subpoenaed; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any personal information pursuant to a subpoena; (iii) if we are sold, merged or acquired (collectively, “M&A Transactions”) (including where we share your personal information in connection with the due diligence process associated with a potential M&A Transaction); or (iv) if we are the subject of bankruptcy proceedings; provided, however, that if we are involved in an M&A Transaction or bankruptcy proceeding, you will be notified via email and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information.
Credit Card, Debit Card and Online Payment Transactions
Alex and Ani® utilizes third-party service providers to provide credit and debit card payment processing services, and Alex and Ani® utilizes Afterpay®, Amazon Pay®, Google Pay®, Klarna®, PayPal® and Shop Pay® (collectively, “Online Payment Accounts”) to process purchases, where users select one of those payment methods. If you choose to purchase Alex and Ani® Products and/or Gift Cards: (a) with a credit card or debit card, the credit or debit card information provided will be shared with our contracted third-party payment processing service provider(s); and (b) with an Online Payment Account, your purchase information will be shared with the applicable Online Payment Account. Alex and Ani® requires that its third-party payment processing service provider(s) has/have in place privacy policies and practices consistent with this Privacy Policy; provided, however, that we cannot guarantee the privacy practices of our third-party payment processing service provider(s) and/or Online Payment Account providers.

Geolocation Tracking
Alex and Ani® does not use geolocation technology to track users’ locations; provided, however, that our retail store-specific services, such as find-an-item, require a zip code to function.
Aggregate Data
Alex and Ani® reserves the right to transfer and/or sell aggregate or group data about users of the Site Offerings for lawful purposes. Notice of Financial Incentive
The JEWELRY LOVE CLUB, Alex and Ani’s® loyalty program (the “Program”), is offered by Alex and Ani® to customers that make purchases on the Site, as well as to potential customers. Alex and Ani® offers certain perks and privileges to users who join the Program ("Members”). As Members spend money on Alex and Ani® Products, and complete certain designated activities, they earn points for each eligible dollar spent (“Points”), and attain various tiers of Program membership based on Points earned (“Tiers”). Points can be exchanged for eligible Alex and Ani® Products.
In order to become a Member of the Program, you must submit the following information on the registration form made available on the Program page of the Site: (a) first name; (b) last name; and (c) email address. Alex and Ani® uses this personal information to improve its Products, services and customer experiences. Program Membership is optional and you may cease using it at any time. Members may continue to use their Points after they cease using their Memberships.
The value of the consumer personal information provided in order to become a Member of the Program is based upon our reasonable, but sole, determination of the estimated value of such information. We calculate this value by considering, without limitation, estimates regarding anticipated revenue that we may generate from such information, anticipated expenses which may be incurred in the collection, storage, use and sharing of such information in the operation of our business, and other relevant factors, as permitted under Applicable State Laws (“Valuation Criteria”). Using the Valuation Criteria, we estimate the value of personal information we request from Program Members, in part, by comparing the amount spent by Program Members to similarly situated customers who do not participate in the Program over a twelve (12) month period.
Alex and Ani® also offers users a discount that can be applied to future purchases on the Site where users register to receive the Alex and Ani® Newsletter. In order to register to receive the Newsletter, you must submit your: (i) birth month; (ii) birth date; and (iii) email address. Alex and Ani® uses this personal information to contact you regarding your use of the Site, our Products and related offerings. Registering for the Newsletter is optional. Once you register for the Newsletter, you may opt out at any time by utilizing the unsubscribe link each Newsletter email, or by sending an email to dataprotection@alexandani.com. Users may continue to use their discount after opting out of the Newsletter.

- To fulfill or meet the reason for which the information is provided. Access to Specific Information and Data Portability Rights
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable Covered User request, we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting or selling that personal information.
- The categories of third parties with whom we have shared that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).
- If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable Covered User request, we will delete (and direct our service providers, contractors and third parties to whom we shared your personal information, to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests (and for no other purposes), we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you.
We may deny your deletion request if retaining the information is necessary for us or our service providers, contractors and third parties to whom we sold/shared your personal information, to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech rights, ensure the right of another Covered User to exercise her/his free speech rights or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, but only if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with Covered User expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Right to Request Correction of Inaccurate Personal or Sensitive Personal Information
You have the right to request correction of inaccurate personal and/or sensitive personal information that we collect. Upon receiving a verifiable consumer request for correction, we will make commercially reasonable efforts to correct information identified as inaccurate. Where we correct inaccurate personal and/or sensitive personal information, we shall instruct all service providers and/or contractors that maintain such personal and/or sensitive personal information in the course of providing services to us to make the necessary corrections in their respective systems.
Exercising Access, Data Portability, Right to Correct and Deletion Rights

The verifiable Covered User request must:
- Provide sufficient information that allows us to reasonably verify that you are: (1) the person about whom we collected personal information; or (2) an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable Covered User request does not require that you create an account with us. We will only use personal information provided in a verifiable Covered User request to verify the requestor's identity or authority to make the request.
Response Timing and Format
We endeavor to respond to all verifiable Covered User requests within forty-five (45) days of the receipt thereof. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures that we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response that we provide will also explain the reasons that we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable Covered User request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
If we deny any Covered User access/right to know, data portability, right to correct and/or deletion rights request, you may submit an appeal of our decision within thirty (30) days of your receipt of our notice of denial by e-mailing us at: dataprotection@alexandani.com; or sending us U.S. Mail to: LMGL, LLC, Attn: Data Protection, 3 E Evergreen Rd., Suite 101 PMB 923, New City, NY 10956.
Right to Opt-Out of Profiling
You have the right to opt-out from any Profiling that may be conducted by Alex and Ani®. For purposes of these Provisions, "Profiling" means any form of automated processing performed on your personal data to evaluate, analyze or predict personal aspects related to you or your economic situation, health, personal preferences, interests, reliability, behavior, location or movements. For purposes of these Provisions, "Targeted Advertising” means displaying advertisements to you where the advertisements are selected based on personal data obtained from your activities over time and across nonaffiliated websites or online applications to predict your preferences or interests. Authorized Agents
Covered Users may permit an Authorized Agent to exercise any rights granted under Applicable State Laws as set forth above. In order to utilize an Authorized Agent, you must provide the Authorized Agent with written permission from you to act on your behalf for these purposes. When you use an Authorized Agent to submit a request to delete, request to correct or a request to know, we may require the Authorized Agent to provide proof that you gave the agent signed permission to submit the subject request. We may also require you to do either of the following: (a) verify your own identity directly with us; or (b) directly confirm with us that you provided the Authorized Agent permission to submit the request.
For California residents, only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable Covered User request related to your personal information.
Non-Discrimination
We will not discriminate against you for exercising any of your rights under Applicable State Laws. Unless permitted by Applicable State Laws, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
- Provide you a different level or quality of goods or services;
- Retaliate against any employee, job applicant or independent contractor; and/or
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Changes to these Privacy Provisions
We reserve the right to amend these Privacy Provisions in our discretion and at any time. When we make changes to these Privacy Provisions, we will notify you by email or through a notice on the Site’s homepage.

Mobile Terms of Service (Last updated: May 16, 2024)
The ALEX AND ANI mobile message service (the "Service") is operated by ALEX AND ANI (“ALEX AND ANI”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to ALEX AND ANI’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of ALEX AND ANI through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, product launches, abandoned cart, site browse abandonment, sales, special offers, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with ALEX AND ANI. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to 35706 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other ALEX AND ANI mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
